These Terms of Service along with our Privacy Policy which is incorporated herein by reference (collectively the “Terms”) govern your access to and use of www.taxihack.com (the “Taxihack Site”) and the services offered thereon (the “Services”), and any information, text, graphics, or other materials uploaded, downloaded or appearing on the Services (collectively referred to as “Content”). Your access to and use of the Services is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Services you agree to be bound by these Terms. If you do not agree with Terms please do not use the Site or Services.
Eligibility
You must be 18 or over, or the legal age to form a binding contract in your jurisdiction if that age is greater than 18 years of age, to use the Site and the Service. If you are under the age of 18, do not access or use any Services. You may use the Services only in compliance with these Terms and all applicable local, state, national, and international laws, rules and regulations.

Taxihack reserves the right to change the Services or to stop providing the Services to you or to users of the Services in general at any time, for any reason without notice to you.

The Services include a combination of Content that Taxihack creates, that third parties create, and that you and our other users create. All Content published, displayed, cached or made available on the Service is protected by copyrights and may be protected by other intellectual property rights such as trademarks. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display, or in any way exploit any of the Content on the in whole or in part unless expressly permitted by the Content owner.
The person who posted the Content to the Services originally is the sole person responsible for that Content. Taxihack does not control the Content posted via the Services and assumes no responsibility for monitoring the Site or Services for inappropriate Content. You understand that by accessing and using the Services you may be exposed to Content that you find offensive, harmful, inaccurate, indecent, or otherwise inappropriate. In some cases, Content posted via the Services may be deceptive. Taxihack neither guarantees the accuracy, reliability, integrity or quality of any Content nor does it endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Services. Under no circumstances will Taxihack be liable in any way for any Content, including without limitation, any errors or omissions in any Content, any Content that is libelous or defamatory, or any loss or damage of any kind incurred as a result of your use of any Content. Any use or reliance on any Content posted via the Services or obtained by you through the Services is at your own risk. You agree that you must evaluate and bear all risks associated with the use of any Content and the Services.
Submitting Content
By uploading, emailing, tweeting, sending or otherwise making available your Content to Taxihack via the Services, you grant us a royalty-free, fully paid-up, non-exclusive, perpetual, sublicensable right and license to (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute your Content in any and all media or distribution methods (now known or later developed). This license includes the right for Taxihack to make your Content available to third parties who may partner with us for the broadcast, distribution or publication of such Content on other media and services. You understand and agree that you will not receive any compensation for any such additional uses.
You represent and warrant that you have all the rights, power and authority necessary to grant the rights granted herein to any Content that you submit and that such Content is not pornographic or obscene. You are responsible for any Content you submit, for your use of the Services, and for any consequences relating thereto including, without limitation, the use of your Content by others. You understand that the Content you subject may be posted on the Site by Taxihack or its third party partners and if you do not have the right to submit Content for such uses, it may subject you to liability. Taxihack will not be responsible or liable for any use of your Content by Taxihack in accordance with these Terms.
Taxihack reserves the right at all times (but does not have an obligation) to remove or refuse to distribute any Content on the Services at any time, for any reason in its sole discretion.
Privacy
Any Content that you provide to Taxihack is subject to our Privacy Policy, which governs our collection and use of your information. You understand that through your use of the Services you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to the United States and/or other countries for storage, processing and use by Taxihack.
Your License to Use the Services
Taxihack grants you a limited, non-exclusive, non-transferable, revocable right and license to use make personal use of the Services in accordance with these Terms. This license is for the sole purpose of enabling you to use the Services in the manner permitted by these Terms.

All right, title and interest in and to the Services (excluding Content provided by users) are and will continue to be the property of Taxihack and its licensors (e.g. other users like you). The Services are protected by copyrights, moral rights, trademarks, service marks, patents, trade secrets, and other proprietary and intellectual property rights and other laws, in the United States and worldwide. All rights not expressly granted herein are fully reserved by Taxihack and its licensors. These Terms do not grant you any rights to use any Taxihack trademark, logo or other brand features. If you provide us with feedback, suggestions or requests for changes to the Services, we are not obligated to act on them but we will have the right to use them without any financial or other obligation to you. Subject to the provisions of these Terms and the rights you have granted herein, as between you and Taxihack, you will continue to own all right, title and interest in and to any Content you submit to the Services.
Disclaimer of Warranties
TAXIHACK PROVIDES THE SERVICES ON AN "AS IS" AND “AS AVAILABLE” BASIS. YOU EXPRESSLY AGREE THAT USE OF THE SERVICES IS AT YOUR OWN RISK
WITHOUT LIMITING THE FOREGOING, TAXIHACK, ITS LICENSORS AND ADVERTISERS DISCLAIM ANY WARRANTIES, EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. TAXIHACK MAKES NO WARRANTY AND DISCLAIMS ALL RESPONSIBILITY AND LIABILITY FOR THE COMPLETENESS, ACCURACY, AVAILABILITY, TIMELINESS, SECURITY OR RELIABILITY OF THE SERVICES OR ANY CONTENT PROVIDED VIA THE SERVICES. TAXIHACK WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY HARM TO YOUR COMPUTER SYSTEM, LOSS OF DATA, OR OTHER HARM THAT RESULTS FROM YOUR ACCESS TO OR USE OF THE SERVICES, OR ANY CONTENT. YOU ALSO AGREE THAT TAXIHACK HAS NO RESPONSIBILITY OR LIABILITY FOR THE DELETION OF, OR THE FAILURE TO STORE OR TO TRANSMIT, ANY CONTENT AND OTHER COMMUNICATIONS MAINTAINED BY THE SERVICES. WE MAKE NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM TAXIHACK OR THROUGH THE SERVICES, WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.
IN THE EVENT THAT ANY APPLICABLE LAW DOES NOT PERMIT THE EXCLUSION OF SOME OR ALL OF THE ABOVE IMPLIED WARRANTIES TO APPLY TO YOU, THE ABOVE EXCLUSIONS WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
Linked Sites
You may be able to link to third parties' Websites ("Linked Sites") from the Services. Linked Sites are not, however, reviewed, controlled or examined by Taxihack in any way and Taxihack is not responsible for the content, availability, advertising, products or other materials of any such Linked Sites, or any additional links contained therein. It is your sole responsibility to comply with the appropriate rules and guidelines, if any, applicable to the use of the Linked Sites. UNDER NO CIRCUMSTANCES WILL TAXIHACK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, ADVERTISERS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) THE USE OF OR INABILITY TO USE THE SERVICES OR CONTENT; (B) ANY CONTENT OBTAINED FROM THE SERVICES; OR (C) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY OFFENSIVE, ILLEGAL OR LIBELOUS CONDUCT OF OTHER USERS OR THIRD PARTIES. Indemnification
You agree to defend, indemnify, and hold harmless Taxihack, its licensors and advertisers and their employees, contractors, members, managers, officers, shareholders, agents and directors (“Indemnified Parties”) from all liabilities, claims, losses, damages, obligations, costs, and expenses, including attorney's fees, that are due to, arise from or relate to: (a) your use of and access to the Services; (b) Content you submitted to the Services; (c) your violation or breach of any of these Terms; or (d) your violation of any law or the rights of any other person or entity including, but not limited to, claims for defamation, violation of rights of publicity and/or privacy, copyright infringement, or trademark infringement. This defense and indemnification obligation will survive your use of the Services. Taxihack reserves the right to assume the exclusive defense and control of any claim for which we or any of the Indemnified Parties are entitled to indemnification hereunder. In such event, you shall pay all fees and costs for such defense and shall provide us with such cooperation at no charge as is reasonably requested by us to assert any available defenses.
Advertisements
The Services may include advertisements. The types and extent of advertising by Taxihack on the Services are subject to change. In consideration for Taxihack granting you access to and use of the Services, you agree that Taxihack and its third party providers and partners may place such advertising on the Services or in connection with the display of Content from the Services whether submitted by you or others.
Choice Of Law and Venue
You agree that the laws of the State of New York, excluding its conflicts-of-law rules, shall govern your use of the Services, Content accessed via the Services and these Terms. Your use of the Services may be subject to other local, state, national, and international laws. You expressly agree that any dispute and/or claim arising out of or in connection with your use of and/or inability to use the Services or Content shall be heard in the County of New York, State of New York. You hereby knowingly, voluntarily, and intentionally waive, to the fullest extent permitted by applicable law, the right to trial by jury in any legal proceeding arising out of or relating to this Agreement or the transactions contemplated hereby.
Services Operation
Taxihack controls and operates the Services and Site from Taxihack offices in the United States of America. Taxihack does not represent that Content accessed via the Services and Site are appropriate or available for use in other locations. Persons who choose to access the Services, Site and Content from other locations do so on their own initiative, and are responsible for compliance with local laws, if and to the extent local laws are applicable.
Severability
If any term, condition, or provision of these Terms, or portion thereof, is found to be invalid, unlawful or unenforceable to any extent, the parties shall endeavor in good faith to agree to such amendments that will preserve, as far as possible, the intentions expressed in these Terms. Such invalid term, condition or provision will be severed from the remaining terms, conditions and provisions, which will continue to be valid and enforceable to the fullest extent permitted by law.
Waiver
Any waiver of the provisions of these Terms or of a party’s rights or remedies under these Terms must be in writing to be effective. Failure, neglect, or delay by a party to enforce the provisions of these Terms or its rights or remedies at any time, will not be construed and will not be deemed to be a waiver of such party’s rights under these Terms and will not in any way affect the validity of the whole or any part of these Terms or prejudice such party’s right to take subsequent action. Except as expressly stated in these Terms, no exercise or enforcement by either party of any right or remedy under these Terms will preclude the enforcement by such party of any other right or remedy under these Terms or that such party is entitled by law to enforce.
Assignment
These Terms, and any rights and licenses granted hereunder, may not be assigned or transferred by you, but may be assigned, transferred or sold by Taxihack without restriction. Any attempt by you to assign, transfer or delegate these Terms shall be null and void. These Terms will bind and inure to the benefit of Taxihack's successors and assigns.
Entire Agreement and Modification
These Terms, together with the Privacy Policy, constitutes the entire agreement between you and Taxihack related to the subject matter thereof, supersedes any prior or contemporaneous (oral, written or electronic) agreement between the parties. Taxihack reserves the right to modify, add or remove any provisions in these Terms without notice or liability to you. Any modifications we make will be effective immediately upon posting to the Site, and your continued use of this Site following the posting of any changes to the Terms constitutes your acceptance of such changes. Please check the Terms periodically for changes.
Copyright Policy
If you believe in good faith that any Content made available through the Services has been copied in a way that constitutes copyright infringement, you may forward the following information to our Copyright Agent at support@taxihack.com: (a) your contact information, including your name, address, telephone number, and email address; (b) a sufficiently detailed description of the copyrighted work that you believe has been infringed; (c) the exact URL or location of the material that you claim is infringing; (d) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (e) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; and (f) a statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owners.
We reserve the right to remove Content alleged to be infringing without prior notice and at our sole discretion.
